Quibi — Jeffrey Katzenberg’s short-lived, short-form premium video startup — shut its doors nearly a year ago. But it has lived on as holding company because of a legal battle with interactive-video firm Eko, which alleged Quibi stole trade secrets and infringed Eko patents.

Now the companies have buried the hatchet: Eko and QBI Holdings LLC announced that they have agreed to dismiss all of their legal claims against each other.

Under the terms of the settlement, QBI Holdings (formed after the Quibi programming assets were sold to Roku and the Quibi app was shut down) will transfer the intellectual property and technology for the Turnstyle mobile-video viewing feature to Eko. Turnstyle had been at the heart of the dispute.

Financial terms of the settlement are not being disclosed. A source familiar with the agreement told Variety that no money is changing hands between the companies.

“We are satisfied with the outcome of this litigation, and proud of the independently created contributions of Quibi and its engineering team to content presentation technology,” Katzenberg, founder and chairman of Quibi, said in a prepared statement.

Eko founder and CEO Yoni Bloch commented, “This result will help ensure that Eko remains the undisputed leader in interactive storytelling technology.”

According to the companies, “The parties will have no further comments regarding the lawsuits or their resolution.”

In March 2020 — less than a month before the ill-fated launch of Quibi’s mobile subscription service — Eko sued Quibi over Turnstyle, the technology Quibi used to determine the orientation of a viewer’s phone (either horizontal or vertical) and display the content in the appropriate mode. Eko had been seeking more than $100 million in damages from Quibi.

A judge in a December 2020 found “sufficient” circumstantial evidence that three former Snap employees — who had received an NDA briefing from Eko’s Bloch on his company’s interactive-video tech before joining Quibi — had engaged in theft of trade secrets, as Eko had alleged. But the court denied Eko’s request to freeze Quibi’s assets because “Eko has not shown it will more likely than not succeed on its [patent] infringement claims.”

The Eko lawsuit against Quibi was funded by activist hedge fund Elliott Management, which acquired a minority equity stake in the company last year.

The legal fight took a personal turn: In a court filing, Quibi suggested that Paul Singer, Elliott’s founder and co-CEO, was backing the Eko suit because his girlfriend’s son works at the company. “Although media coverage has suggested that Elliott brings gravitas and a rigorous analysis to its litigation investments, Elliott’s motivation for involvement in the lawsuit appears personal,” Quibi said in a February 2021 filing. In response, Elliott general counsel Richard Zabel had said, “The irrelevance of Quibi’s focus on personal matters in order to put forward a false narrative about Elliott’s role related to this case demonstrates Quibi’s reluctance to engage forthrightly on the actual underlying legal issues. Elliott decided to finance this litigation because we strongly believe that Eko will prevail in its claim that Quibi stole its valuable intellectual property.”

In addition to Elliott Management, Eko’s shareholders include Walmart, which invested $250 million in the company as part of a content-development pact.

Roku plans to develop more than 50 original shows over the next two years in a bid to drive more customers to its Roku Channel, according to a report from the Wall Street Journal.

The streaming service, which has roughly 155 million customers, has been bulking up the channel’s free library of shows and movies for some time and it is now looking for a way to profit. The company said roughly half of its customer base watches the channel’s free ad-supported shows and movies, which it licenses from more than 200 other media outlets.

The push into original shows is linked in part to the fact that Roku can gain more advertising dollars from titles housed in the Roku Channel. Roku declined to provide insight on how much it would fork over for original shows, but it told the Journal that it would be on par with basic cable shows.

That translates to a $250,000 to $750,000 investment per unscripted episode and $500,000 to $5 million per scripted episode, the publication said.

Although that sounds pricey, it’s still significantly lower than the $13 million an episode that Netflix shells out for its historical drama about Queen Elizabeth II, “The Crown.”

Unlike Netflix, Roku primarily makes its money from selling its $30 streaming stick, as well as from ads in streaming apps that live on its platform and content partnerships with media companies.

In order to keep growing revenue, Roku has been expanding its entertainment portfolio as it competes head to head for eyeballs against Amazon Fire TV. Earlier this year, Roku nabbed the exclusive global rights to 75 shows from Jeffrey Katzenberg’s doomed startup Quibi, which featured short-form shows starring the likes of Kevin Hart, Idris Elba, Jennifer Lopez and Nick Jonas.

Roku claims the Quibi deal, which cost it less than $100 million, has “surpassed” its “expectations,” bringing in “millions of people” to the Roku Channel. Although it doesn’t break out figures, Roku said the amount of time customers streamed its content rose significantly during the pandemic. Last year, the service brought in nearly $1.3 billion in revenue from its platform business, which includes ads it sells in the Roku Channel and other apps on its platform.

While Roku didn’t provide details on the 50 planned shows it will bring to the service in the next two years, it has renewed Quibi action series “Most Dangerous Game” and the Kevin Hart comedy “Die Hart,” whose second season will be called “Die Harter.” The company said some of the new shows will include series it acquired from Quibi that haven’t yet premiered.

Other original titles will include Roky’s first original film, “Zoey’s Extraordinary Christmas,” a spinoff of the NBC show “Zoey’s Extraordinary Playlist” produced in a partnership with Lions Gate Entertainment. It will debut on the service on Dec. 1.

“We were one of the first studios to team up with The Roku Channel in 2017, and our relationship has continued to evolve to include the development of great original projects such as ‘Zoey’s Extraordinary Christmas’ in addition to our longstanding licensing collaboration,” Lionsgate president of worldwide television distribution Jim Packer told The Post. “As The Roku Channel continues to build its leadership as a top platform in the AVOD [advertising-based video on demand] space, we’re excited to continue growing our partnership.”

T-Mobile is once again offering its customers a free streaming deal: starting on November 9th, any T-Mobile or Sprint customer (new or existing) on post-paid cellular or home internet plans can sign up to get a free year’s subscription of Paramount Plus Essential.

As always, there are caveats for the deal. The promotion only includes access to Paramount Plus’ Essential plan, which typically costs $4.99 per month and has “limited commercial interruptions.” Additionally, unlike the $9.99 per month Premium plan, it doesn’t include a live feed of your local CBS station, although NFL and Champions League games are still available on the lower tier.

For new Paramount Plus subscribers, or customers who are already subscribed to the Essential monthly plan, you’ll be able to go to T-Mobile’s promotional site on November 9th, log into your account, and either sign up for a free account or get a coupon code for your existing Paramount Plus subscription.

If you’re a Premium customer looking to take advantage of the deal or bought an annual subscription to the service, you’ll have to cancel your existing account, wait until the end of your billing cycle, and then make a new account through the T-Mobile offer. (Additionally, if you’re on the grandfathered in “Limited Commercials plan” from CBS All Access, Paramount Plus warns that you won’t be able to get it back if you do cancel.)

Additionally, in order to sign up for the deal, you’ll have to give Paramount Plus your credit card information — which the company will use to start charging you for your subscription after the year is up. And in a rather off-putting move, the promotional page clearly warns that “Paramount Plus will not send a reminder alerting you of your upcoming offer expiring,” — so you’ll want to make sure you keep an eye on when your free year is up if you’re looking to avoid getting charged.

The new deal is by no means T-Mobile’s first free streaming promotion: the company has given unlimited customers free Netflix for years and recently offered Magenta and Magenta Plus subscribers a free year of Apple TV Plus, too. It even once gave customers with multiple active lines a year of free Quibi access (although, given that Quibi only lasted for seven months, that may not have been the best of deals.)

Netflix is the world’s largest streaming service, with 183 million subscribers (as of March 2020) paying monthly to watch shows like Stranger Things, The Crown and the rest of the streamer’s extensive movie and TV catalog. Until recently, it also had one of the most generous free trials of any streamer, with new subscribers able to get a whole month of the service free.

However, in October 2020, the service removed its free trial in the U.S., with a spokesperson for Netflix saying, “we’re looking at different marketing promotions in the U.S. to attract new members and give them a great Netflix experience.”

This removal of the Netflix free trial reflected the massive changes in the streaming sector is the short term in response to the coronavirus pandemic and in the long term since Netflix launched its first original series in 2013.

In the short term, a number of streaming services dropped their free trial in 2020 as a result to minimise any losses they were making after bringing movies originally destined for cinematic release to streamers.

When Disney+ released Hamilton onto its service, as well as Pixar movie Soul, these were major releases that would bring millions to the service, but they would also bring a significant audience of people who would watch these films on a free trial and then cancel their subscription.

This would allow these viewers to watch them for free—and when Soul cost a reported $150 million, and Hamilton cost $75 million, the company needed as many viewers paying for it as possible. The same with Wonder Woman 1984 and the other Warner Bros. movies coming to HBO Max in the next year.

Though Netflix did not have a 2020 release as hyped and major as any of those blockbuster releases, it does have what almost no other streamer services has—a huge arsenal of hugely popular originals.

Whereas newer streamer services like Disney+ or HBO Max have one or two breakout shows like The Mandalorian or Raised By Wolves, Netflix has some of the most-watched shows in the world, like Stranger Things, The Crown and Ozark. So if the newer streamer could build an audience without luring people in for free, then presumably the thinking was that so could Netflix, especially as millions around the world found themselves at home due to the coronavirus, with few options other than binge-watching endless TV.

In the long-term, meanwhile, the market has been moving away from free trials in general, with the trials offered getting smaller. The first three major streaming services in the U.S. were Netflix, Hulu and Amazon Prime Video, all of which offered (or in the latter two cases, still offer) 30-day free trials. This was based on the model of cable services like Showtime, which offered month-long free trials for potential viewers.

Now, however, the norm is seven days, with media companies trying to recoup the millions they have pumped into joining the ‘streaming wars’ as quickly as possible. Among the services that offer a week free trial are Peacock, Apple TV+ and Discovery+, all of which launched in 2020.

Quibi, meanwhile, offered viewers who signed up before it released a 90-day free trial, then a 14-day free trial after it aired, which industry commentators cited as one of the many reasons it shutdown just six months after it launched.

Now, however, Netflix has tried to keep one foot ahead of the upstart streaming services by experimenting with alternatives to the free trial.

Rather than offering new subscribers unfettered access to the whole catalog for a length of time, the streamer has introduced Watch Free, a segment that allows viewers to watch selected episodes of its biggest shows, hoping to get viewers hooked enough to pay to watch the whole thing.

Among the shows currently available to watch free are episodes of Stranger Things, Grace and Frankie, Spanish teen soap Elite, kid’s content like Boss Baby: Back in Business and the acclaimed mini-series When They See Us.

Based on the sitcom created by Rich Eustis & Michael Elias that aired on ABC from 1986-91, Head Of the Class revolves around a group of overachieving high school students who meet their greatest challenge — a teacher, Alicia Gomez, played by Isabella Gomez, who wants them to focus less on grades and more on experiencing life.

The cast of the reboot included Gomez, Jorge Diaz, Jolie Hoang Rappaport, Gavin Lewis, Dior Goodjohn, Brandon Severs, Adrian Matthew Escalona, and Katie Beth Hall, with the original series’ Robin Givens guest-starring alongside Christa Miller. Givens reprised her role as Darlene Hayward.

Lawrence, Pocha and Cohen executive produced with Jeff Ingold for Doozer, Phill Lewis and Bill Callahan. Doozer’s Liza Katzer served as co-executive producer. Pocha & Cohen wrote and Lewis directed the pilot episode for the series from Doozer Productions, in association with Warner Bros. Television.

This marks only the second original scripted series on HBO Max to get canceled so far, joining fellow comedy Generation. (Both targeted teen audiences.) Head Of the Class was the streamer’s only original multi-camera sitcom.
